GENERAL TERMS & CONDITIONS (T&C) RENTAL SERVICES IRIDE NAIROBI Version 05.12.2023 1. BASIS OF T&C’s These General T&Cs are part of any booking confirmation between iRideNairobi (further : The Owner) and its Customer (further: The Renter) who is using any service of iRideNairobi 2. CONDITION OF VEHICLE The Owner states that to the best of his knowledge the rented vehicle is in safe condition and free of any known defects which would affect its safe operation under normal use. The vehicle has been checked, serviced and found fit for use. A basic tool kit may also be provided. Furthermore, during pick-up and drop-off, Renter and Owner will follow a checklist together to confirm vehicle condition 3. QUALIFICATIONS The Renter states that (s)he is physically and legally qualified to operate the rental vehicle. 4. EXCLUSIONS The rented vehicle shall not be used for any illegal purpose, operated in a negligent manner nor by an unlicensed rider/ driver. 5. REFUELING POLICY The Renter hereby agrees to give the Vehicle back with the same quantity of fuel as had been in the tank upon rental start. 6. INSURANCE: The Renter hereby acknowledges that the insurance covers accidents and theft, as long-as non-negligent behavior was displayed. The Renter acknowledges that damage to him/herself, or any other co- passenger, in the event of an accident is not covered by this insurance. The Renter hereby agrees that he/she shall be held fully responsible for any outstanding payments not covered by the insurance in the case of an accident or theft. Failure to meet the legal qualifications to operate the vehicle will lead to a loss of insurance and require the Renter to cover all incurred costs due to damage or theft on his/her own. Any costs incurred by the Renter/others during the period of the rental fall under the responsibility of the Renter i.e. punctures, oil purchase, mileage interval service. 7. DEPOSIT The Renter agrees to make a deposit per vehicle rented with the Owner, to be used, in the event of loss of or damage to the vehicle during the term of the Booking Confirmation, to defray the cost of necessary repairs or replacement. In the absence of damage or loss, said deposit shall be credited toward payment of any outstanding costs and any excess returned to the Renter. This amount is refundable no later than 14 days after the rental. 8. CANCELLATION POLICY The Owner agrees to avail the vehicle for exclusive use to the Renter for the period indicated in this contract. Should the Renter terminate the contract 2 weeks prior to rental start, the Renter will be fully reimbursed for any prepaid amount. Any cancellations later than 2 weeks prior to rental start shall not qualify for reimbursement. Equally, should the Renter terminate the contract before the end of the indicated rental period, the Renter will not be entitled to any compensation. The Owner has the right to terminate the contract if there is any reason to assume the Renter partly materially breaches any of term of this T&C and/or tampers in any material way with the Vehicle without the consent of the Renter. FORCE MAJEUR The Owner will not be liable to the Renter for any failure or delay in performing his/her obligations, which arise because of any circumstances which it cannot reasonably be expected to control (including any fire, flood, earthquake, natural disaster, act of war etc. 10. RENTER’s OWN RISK The Renter accepts the risk of driving in general and of driving in Kenya specifically. The Renter will not hold the Owner liable in any way for damage resulting from accidents in which the Renter may be involved. The Renter is taking any service of the Owner at own Risk 11. RESPONSIBILITIES The Owner is responsible for any Vehicle issues that emerge during the term of their Vehicle Rental Period which demonstrably result from issues with the Vehicle itself and are in no way the result of the actions of the Renter. The Owner will cover any maintenance costs to the Vehicle that result from such an event and provide a back-up vehicle (Land cruiser, KTM, Kibo or Boxer) if necessary. The Owner will not be responsible for any additional costs incurred to the Renter as a result of the Vehicle issue. It is the responsibility of the Renter to pay for and manage any maintenance related issues which result from the use of the Rented Vehicle during the term of their Rental Period. The Renter agrees to indemnify, defend, and hold harmless the Owner for any loss, damage, or legal actions against the Owner as a result of the Renter's own operation or use of the Rented Vehicle during the Rental Term. The Renter is responsible for all additional costs that might arise at the end of the rental due to damage to the Vehicle i.e. logistics, recovery, insurance assessment and labour as well as a 10% of rental total cost per Vehicle for unplanned equipment downtime. 12. JURISDICTION: The parties consent that this is a legal binding document in the Republic of Kenya. Page 2/2
Note: Foreign driving licenses are valid in most countries including the Philippines for the next 90 days after arrival. After 90 days foreign driving license is required to be converted to the local standard. Remember that if you are planning a long trip!
