4. Use of Motorcycle
Permitted Use: The Renter agrees to use the motorcycle only for personal, lawful, non-commercial purposes within the Philippines.
Driver’s License Requirement: The Renter certifies that they hold a valid motorcycle driver’s license (Philippine LTO License).
Prohibited Use: The Renter shall not use the motorcycle for racing, stunts, off-road activities, or any purpose that may cause undue wear and tear.
Operation by Others: The Renter shall not allow others to operate the motorcycle without the Company’s prior consent.
Substance Use: The Renter agrees not to operate the motorcycle while under the influence of alcohol, drugs, or any substances impairing their ability to drive.
5. Condition of Motorcycle
The Company shall provide the motorcycle in good working condition. The Renter agrees to inspect the motorcycle prior to rental and notify the Company of any existing damages.
A pre-rental inspection form will be completed and signed by both parties, documenting the motorcycle’s condition at the time of rental.
Return Condition: The Renter agrees to return the motorcycle in the same condition as received, excluding normal wear and tear.
6. Insurance and Liability
Insurance: The Renter acknowledges that any third-party insurance coverage applicable to the motorcycle is the minimum required by law.
Liability for Damage: The Renter assumes full responsibility for any damage, loss, or theft of the motorcycle during the rental period, excluding normal wear and tear. The Renter will be charged for repairs, replacement costs, or the deductible under any applicable insurance, whichever is lower.
Personal Injury/Property Damage: The Company shall not be liable for any injury or property damage arising from the Renter’s use of the motorcycle.
7. Fuel
Fuel Level at Start: _______________
The motorcycle must be refueled with Unleaded Regular/Premiumgasoline. Failure to use the correct fuel type will result in repair charges borne by the Renter.
The Renter agrees to return the motorcycle with the same level of fuel as at the start of the rental. Failure to do so will result in a refueling charge of ₱300.
8. Helmet and Safety Gear
The Company provides helmets as part of the rental agreement. The Renter is required to use the helmet at all times while operating the motorcycle.
9. Breakdown and Repairs
In case of breakdown, the Renter must notify the Company immediately.
Any repairs or modifications to the motorcycle must have the Company’s prior written consent.
Emergency Assistance: The Company will provide emergency contact details for assistance if required during the rental period.
10. Accident Reporting
In case of an accident, the Renter must:
Immediately contact the Company and local authorities.
Provide a full incident report and necessary documentation, including photos if possible.
11. Cancellation Policy
Cancellations made at least 48 hours before the start of the rental period will receive a full refund.
Cancellations within 48 hours will incur a fee of ₱__________.
12. Termination of Agreement
The Company reserves the right to terminate this Agreement and reclaim the motorcycle if the Renter breaches any terms herein.
13. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Republic of the Philippines.
14. Privacy and Data Protection
The Company will securely store Renter information for record-keeping purposes and will not share it with third parties unless required by law.
15. Dispute Resolution
In the event of a dispute, the parties agree to attempt to resolve it through mediation before pursuing legal action.
16. Entire Agreement
This Agreement constitutes the entire understanding between the parties and supersedes any prior agreements. Any modifications must be in writing and signed by both parties.
Note: Foreign driving licenses are valid in most countries including the Philippines for the next 90 days after arrival. After 90 days foreign driving license is required to be converted to the local standard. Remember that if you are planning a long trip!
