TERMS AND CONDITIONS 1. Driver’s License: The renter must present a valid driver’s license before renting the vehicle. 2. Fuel Policy: Vehicle must be returned with the same fuel level as when released. 3. Prohibited Use: o Strictly no drunk driving or reckless driving. o No smoking, racing, or off-road driving. o Vehicle cannot be sub-rented or used for illegal activities. 4. Damage or Loss (Non-Negotiable Clause): o The renter shall be fully responsible and liable for any and all damages to the vehicle, whether minor or major, accidental or intentional, including but not limited to interior damages (such as seat stains, burns, tears), scratches, dents, broken parts, or mechanical damage caused during the rental period. o This obligation is absolute and cannot be waived, reduced, or disregarded for any reason. The renter agrees to immediately pay the cost of repair or replacement as assessed by CM Car Rental. o Any attempt to deny, avoid, or delay payment for damages shall be considered a breach of contract and may result in legal action and forfeiture of the security bond. 5. Late Return: ₱150 per hour overtime charge applies after the agreed return time. 6. Identification and Verification: o The renter must present at least two (2) valid government-issued IDs and allow CM Car Rental to take photos or photocopies of the IDs for verification and record purposes. o The Lessor reserves the right to verify renter identity and contact references before releasing the vehicle. 7. Cleanliness: Vehicle must be returned clean. A ₱300 cleaning fee applies if excessively dirty. 8. Theft or Total Loss: o In the event of theft, carnapping, or total loss of the vehicle during the rental period, the renter shall immediately report the incident to both the Lessor and local authorities. o The renter agrees to pay an amount equivalent to twice (2x) the current market value of the vehicle as compensation for total loss, inconvenience, and breach of trust. o This liability applies regardless of cause, whether due to negligence, third parties, or unforeseen events. o Failure to comply with this provision shall be considered a serious breach of contract and may result in civil and criminal legal action against the renter. 9. Cancellation Policy: o Cancellations less than 24 hours before the rental time are subject to a ₱500 fee. 10. Deposit Refund: Refund will be issued after full vehicle inspection on the same day. 11. Lessor’s Rights: The owner may terminate the rental without refund if any of the above terms are violated. 12. Emergency Contacts and Repairs: o In case of accident, breakdown, or emergency, the renter must immediately contact CM Car Rental at [09958372387/09938457381]. o The Renter is strictly prohibited from authorizing any repair, replacement, or modification without written consent from CM Car Rental o Unauthorized repairs or alterations will be charged in full to the renter. 13. Payment, Penalties, and Enforcement o All rental fees must be paid in full before the vehicle is released. o Any outstanding charges for damages, loss, penalties, or unpaid balances must be settled within three (3) days from written notice by CM Car Rental. o Failure to settle payments within this period shall incur an additional ₱500 per day penalty until the amount is fully paid. o CM Car Rental reserves the right to deduct unpaid balances or penalties from the security bond or pursue legal collection if necessary.
