CAR RENTAL TERMS AND CONDITIONS These Terms and Conditions govern the rental of the vehicle between the Vehicle Owner/Rental Company (“Lessor”) and the Customer/Renter (“Lessee”). 1. RENTAL PERIOD The rental period shall begin on the agreed date and time of vehicle release and shall end on the agreed return date and time. Any extension of the rental period must be approved by the Lessor. Additional rental charges shall apply for any approved extension. Failure to return the vehicle on time without prior approval may result in additional charges. 2. RENTAL RATES AND PAYMENT The rental rate shall be based on the agreed vehicle, rental period, and applicable package. The Lessee shall pay the required rental fee, security deposit, and other applicable charges before or upon release of the vehicle, as agreed. Additional charges may apply for: Excess rental hours or days Fuel deficiency Traffic and parking violations Toll fees Damage to the vehicle Lost or damaged accessories Cleaning or detailing Unauthorized use of the vehicle Other charges resulting from the Lessee's use of the vehicle 3. SECURITY DEPOSIT A refundable security deposit may be required before the vehicle is released. The deposit may be used to cover damage, missing equipment, unpaid fees, traffic violations, fuel shortages, excessive cleaning, or other obligations incurred during the rental period. Any remaining balance shall be returned to the Lessee after inspection of the vehicle and settlement of all outstanding charges. 4. DRIVER'S LICENSE AND ELIGIBILITY The Lessee and any authorized driver must possess a valid driver's license appropriate for the rented vehicle. The Lessee must provide valid identification and other documents reasonably required by the Lessor. Only drivers authorized and declared in the rental agreement may operate the vehicle. 5. USE OF THE VEHICLE The vehicle shall be used responsibly and only for lawful purposes. The Lessee shall not: Use the vehicle for racing, speed testing, or other competitions; Use the vehicle for towing or hauling unless expressly authorized; Carry illegal, hazardous, or prohibited materials; Use the vehicle for commercial passenger transport without authorization; Allow an unauthorized person to drive the vehicle; Sub-rent or transfer possession of the vehicle; Drive under the influence of alcohol, illegal drugs, or impairing substances; Use the vehicle in a manner that may cause unreasonable damage or risk. The Lessee is responsible for ensuring that the vehicle is operated safely and in accordance with applicable laws. 6. VEHICLE CONDITION The Lessee acknowledges that the vehicle has been inspected before release and is accepted in its existing condition. The Lessee should report any existing damage or defect before leaving the rental location. Damage not recorded at the time of release may be presumed to have occurred during the rental period, subject to inspection and evidence. The Lessee must immediately notify the Lessor of any mechanical problem, accident, or damage involving the vehicle. 7. ACCIDENTS AND DAMAGE In the event of an accident, the Lessee must: Ensure the safety of all persons involved; Contact the appropriate authorities when necessary; Notify the Lessor immediately; Obtain relevant information from other parties involved; Take photographs or other documentation of the incident when safe to do so; Cooperate with the Lessor and authorities regarding the incident. The Lessee may be responsible for repair costs, loss of use, insurance excess/deductible, towing, recovery, or other reasonable expenses arising from damage caused during the rental, subject to the rental agreement and applicable law. 8. FUEL The vehicle shall be released with the agreed fuel level. The Lessee must return the vehicle with the same fuel level unless otherwise agreed. Any fuel shortage upon return may be charged to the Lessee, including applicable service or refueling fees. 9. TRAFFIC, PARKING, AND TOLL CHARGES The Lessee shall be responsible for all traffic violations, parking fees, toll charges, penalties, and other charges incurred during the rental period. The Lessor may deduct applicable amounts from the security deposit or require separate payment. 10. VEHICLE BREAKDOWN If the vehicle experiences a mechanical breakdown not caused by the Lessee's negligence, misuse, or unauthorized modification, the Lessee shall promptly contact the Lessor for assistance. The Lessee shall not authorize major repairs without prior approval from the Lessor, except when necessary to prevent immediate danger or further substantial damage. 11. PROHIBITED MODIFICATIONS The Lessee shall not modify, alter, install equipment in, or make permanent changes to the vehicle without written authorization from the Lessor. Any resulting damage or restoration cost may be charged to the Lessee. 12. CLEANLINESS The vehicle must be returned in reasonably clean condition. Additional cleaning or detailing charges may be imposed for excessive dirt, stains, spills, smoke odor, pet hair, or other conditions requiring specialized cleaning. 13. SMOKING AND PETS Smoking or vaping inside the vehicle is prohibited unless expressly permitted by the Lessor. Pets may only be transported with the Lessor's prior approval and in accordance with applicable vehicle-use requirements. The Lessee may be charged for cleaning, deodorizing, or repairing damage caused by smoking, vaping, pets, or other prohibited use. 14. LOSS OF KEYS, DOCUMENTS, OR ACCESSORIES The Lessee shall be responsible for the loss or damage of vehicle keys, registration documents, tools, spare tires, remote controls, accessories, and other equipment provided with the vehicle. Replacement or repair costs may be charged to the Lessee. 15. RETURN OF VEHICLE The Lessee must return the vehicle to the agreed location, date, and time. The vehicle must be returned with all keys, documents, accessories, and equipment provided at the beginning of the rental. Late returns may incur additional rental charges. 16. AUTHORIZED TERRITORY The vehicle may only be driven within the territory approved by the Lessor. Travel outside the approved area, including inter-island transportation or use on ferries, requires prior authorization. 17. INSURANCE Any insurance coverage applicable to the rental shall be subject to the terms, conditions, exclusions, and limitations of the relevant insurance policy. The Lessee may remain responsible for amounts not covered by insurance, including applicable deductibles, exclusions, or damage resulting from prohibited or negligent use, as permitted by applicable law. 18. CANCELLATION Cancellation and refund policies shall be based on the agreed rental package and booking conditions. Any applicable cancellation fees shall be communicated to the Lessee before confirmation of the rental. 19. PERSONAL BELONGINGS The Lessor shall not be responsible for personal belongings left inside the vehicle after its return. The Lessee is responsible for checking the vehicle and removing all personal items before returning it. 20. TERMINATION OF RENTAL The Lessor may terminate the rental and recover the vehicle if the Lessee violates these Terms and Conditions, uses the vehicle unlawfully or dangerously, provides false information, fails to make required payments, or otherwise materially breaches the rental agreement. 21. LIABILITY The Lessee shall be responsible for losses, costs, or damages resulting from unauthorized, negligent, reckless, unlawful, or prohibited use of the vehicle, subject to applicable law. Nothing in these Terms and Conditions shall exclude or limit any liability that cannot legally be excluded or limited. 22. DATA AND DOCUMENTS The Lessee agrees to provide accurate information and documents required for the rental transaction. Personal information shall be handled in accordance with applicable privacy and data protection laws and the Lessor's applicable privacy policy. 23. GOVERNING LAW These Terms and Conditions shall be governed by the applicable laws of the Republic of the Philippines, unless otherwise agreed in writing and permitted by law. Any dispute shall first be addressed through good-faith discussion between the parties before pursuing appropriate legal remedies. 24. ACKNOWLEDGMENT AND ACCEPTANCE By signing the rental agreement or accepting possession of the vehicle, the Lessee acknowledges that they have read, understood, and agreed to these Terms and Conditions.
