Vehicle Rental Agreement This agreement outlines the terms and conditions between the vehicle owner and the renter for a self-drive vehicle rental. It specifies the vehicle details, rental duration, authorized drivers, payment terms, and the responsibilities of both parties. Key Provisions ●Authorized Drivers – Only drivers listed in the agreement and holding valid licenses may operate the vehicle. The renter is responsible for any damage, injury, or losses caused during the rental period, subject to insurance coverage. ●Payment and Reservation – A reservation fee is required to secure the booking. Payments are generally non-refundable, although bookings may be rescheduled with at least 24 hours' notice. ●Cancellation Policy – Reservations may be canceled up to 48 hours before the rental date. Late cancellations may incur a charge equivalent to 50% of the rental fee. ●Returns and Extensions – Late returns are subject to hourly or daily penalties. Requests for rental extensions must be made in advance and are subject to vehicle availability. ●Renter Responsibilities – The renter assumes full responsibility for the vehicle while it is in their possession, including damages, traffic violations, fuel costs, toll fees, and losses not covered by insurance. Only authorized drivers may use the vehicle. ●Prohibited Uses – The vehicle must not be driven under the influence of alcohol or drugs, used for illegal activities, subleased, or operated by unauthorized individuals. ●Accidents and Damage – In the event of an accident, theft, or crime, the renter must immediately notify the authorities and cooperate in processing insurance claims. The renter may still be responsible for participation fees and a portion of the vehicle's value in cases of total loss. ●Liability Limitations – The vehicle owner and service facilitator are not responsible for personal belongings left inside the vehicle or for delays caused by natural disasters or other events beyond human control. ●Dispute Resolution – Any disputes arising from the agreement are governed by Philippine law, and legal actions shall be filed in the proper courts of Taguig City. Interest may be charged on unpaid monetary obligations. ●Data Privacy – Renter information and rental records are retained for six months to address possible traffic violations under the No-Contact Apprehension Policy (NCAP). Personal data is handled in accordance with the Data Privacy Act of 2012 and securely disposed of after the retention period.
