MOTORCYCLE RENTER TERMS & CONDITIONS 1. AGREEMENT OVERVIEW This agreement is between the motorcycle rental company/owner ("Owner") and the individual renting the motorcycle ("Renter"). It governs the rental period, use of the vehicle, and responsibilities of both parties, and is subject to Davao City and Philippine laws. 2. RENTAL REQUIREMENTS - Eligibility: Renter must be at least 18 years old (or as per local regulations) and hold a valid Philippine Driver’s License with restriction code for motorcycles (Restriction Code 2 or above). Foreign licenses must be accompanied by an International Driving Permit (IDP). - Documentation: Renter must present valid government-issued ID (e.g., Passport, UMID, Driver’s License) at the time of rental. - Payment: Full rental fee plus security deposit (cash or valid credit/debit card hold) must be provided before taking possession of the motorcycle. 3. RENTAL DETAILS - Vehicle Information: Specify motorcycle make, model, year, plate number, and engine capacity. - Rental Period: Start and end dates/times; late returns will incur additional hourly/daily charges as specified. - Fees: - Base rental rate (per hour/day/week) - Additional charges for extra mileage (if applicable) - Late return penalties - Fuel policy (e.g., Renter must return with same fuel level as when rented) - Security Deposit: Amount will be refunded within 3-5 business days after return, minus deductions for damages, fines, or unpaid fees. 4. RENTER RESPONSIBILITIES - Safe Operation: Operate the motorcycle only in accordance with Philippine traffic laws and Davao City ordinances. - Authorized Use: Only the registered Renter may operate the motorcycle; no subletting or lending to third parties is allowed. - Maintenance & Care: - Perform pre-ride checks (tires, brakes, lights, fuel) and report any issues immediately to the Owner. - Avoid off-road use unless the motorcycle is explicitly designated for it. - Do not modify the motorcycle in any way. - Insurance & Liability: - Renter is responsible for all damages to the motorcycle, injuries to themselves or third parties, and property damage caused during the rental period. - Owner may provide basic insurance, but Renter is encouraged to obtain additional personal accident or liability coverage. - Fines & Violations: Renter is liable for all traffic tickets, fines, or penalties incurred during the rental period. 5. OWNER RESPONSIBILITIES - Provide a motorcycle that is roadworthy, properly registered, and covered by mandatory third-party liability insurance (as required by Philippine law). - Ensure the vehicle has valid registration, OR/CR, and safety equipment (helmet, side mirrors, first aid kit – where applicable). - Disclose all known defects or limitations of the motorcycle to the Renter before rental. - Provide basic operation instructions if requested by the Renter. 6. DAMAGE & LOSS - Accidents: Renter must report any accident, damage, or theft to the Owner and local authorities (PNP Highway Patrol Group or Any Traffic Management Office) immediately. - Deductions: Security deposit may be used to cover repair costs, replacement parts, towing fees, or loss of the motorcycle. If damages exceed the deposit, Renter is responsible for the remaining amount. - Theft: Renter must provide a police report within 24 hours of discovering theft, and comply with all insurance claim requirements. 7. TERMINATION - Early Return: Renter may return the motorcycle early, but no refund will be given for unused rental time unless agreed in writing. - Termination by Owner: Owner may terminate the agreement immediately if the Renter violates any terms (e.g., unauthorized use, reckless driving, operating under the influence of alcohol/drugs) and may confiscate the motorcycle without refund. - Cancellation: Cancellation fees apply if Renter cancels less than [e.g., 24 hours] before the scheduled rental; full refund may be given for cancellations due to force majeure (e.g., natural disasters, government-mandated lockdowns). 8. ADDITIONAL PROVISIONS - Helmet Use: Renter and all passengers must wear a DOT-approved helmet at all times (mandatory under Philippine law). - Passengers: Only allow passengers if the motorcycle is designed for it, and the Renter has the necessary license endorsement. - Fuel: Renter is responsible for all fuel costs during the rental period. - Legal Compliance: This agreement is governed by Philippine laws.   IMPORTANT: By signing this agreement, the Renter confirms they have read, understood, and agree to all terms. Always inspect the motorcycle thoroughly and document any pre-existing damage with photos before taking possession. Thank You & God Bless
Note: Foreign driving licenses are valid in most countries including the Philippines for the next 90 days after arrival. After 90 days foreign driving license is required to be converted to the local standard. Remember that if you are planning a long trip!
