Car Rental/Borrowing Agreement
1. The Renter/Borrower must be at least 21 years old and have an international driver’s license or driver’s license as provided by the government agency and present the original
document on the date entering into this Agreement. The Renter/Borrower agrees and allows his/her identification card or passport or driver’s license to be photographed or
photocopied by the Lessor/Lender.
2. The Renter/Borrower must use the car for tourism or for non-illegal business purposes only. The Renter/Borrower agrees not to commercially rent/borrow the car or commit
offences and agrees not to carry or have illegal items in the car or commit any other acts in violation of state law. If an offense is committed, the Renter/Borrower shall be solely
responsible for such offense.
3. The Renter/Borrower must use the car only in the area that has been informed to the Lessor/Lender as specified herein. If the Renter/Borrower violates and cannot be contacted
by the Lessor/Lender within 2 hours, the Lessor/Lender has the right to notify authorities to take legal actions against the Renter/Borrower immediately.
4. In case the Renter/Borrower performs any acts, besides the agreement stipulated in Clause 2-3, that cause the Lessor/Lender to bring back the car, the Renter/Borrower will be
willing to be responsible for the cost of bringing back the car as charged by the Lessor/Lender.
5. The Renter/Borrower agrees not to sublet, transfer, or deliver the rented car to be driven by others.
6. The Renter/Borrower undertakes that he/she received complete information about the car and insurance from the Lessor/Lender or its representatives on the pickup date.
7. The Renter/Borrower must not drink alcohol while driving or drink alcohol and drive the car. If there is any damage due to such reason, regardless of having intention or not, the
Renter/Borrower must be responsible for such damage entirely.
8. In the case of having damage or accident occurred to the rented car, the Renter/Borrower shall notify the Lessor/Lender of such case immediately, and the Renter/Borrower agrees
to pay fines/initial damages of which rate shall be based on the following reasons and circumstances:

In case of damage caused by insurance-related incidents
a.
In case of accident, if the Renter/Borrower is right, he/she shall not be responsible for the damage.
b.
In case of accident, if the Renter/Borrower is faulty or does not have another party, he/she shall be liable for damage (“initial damage”) at a rate of between
1,000 and 50,000 Baht when it is considered that the damage is within the coverage limit provided by the insurance company, based on the vehicle types listed
in the table below.

Rate of the initial damages shall be upon the consideration of the Lessor/Lender, which shall be deemed as final. In addition, if it is estimated by the insurance
company that the damage is beyond the coverage limit as set, the Renter/Borrower agrees to be responsible for compensating the part of damage that exceeds
the coverage limit provided by the insurance company.

In case of other damages, the rate of fines shall be in accordance with the cover page of this Agreement.
9. The Renter/Borrower must be careful not to lose the rented car. If the rented car is lost for any reason, the Renter/Borrower must present the original key to the Lessor/Lender
only. The Renter/Borrower is obliged to pay the damage at rate of 20 percent of the estimated price of the car or the difference of expenses, as well as the part of damage that
exceeds the coverage limit provided by the insurance company, except for the case where both the original key and the car are lost together, or the case becomes terminated and
there is evidence that is believed or may be believed that the Renter/Borrower is faulty in losing the car. In such case, the Renter/Borrower must pay fully 100 percent of the
estimated cost of the car.
10. The Renter/Borrower allows the Lessor/Lender to inspect or move the car whenever it is considered appropriate by the Lessor/Lender to take any action to prevent damages to the
Lessor/Lender or the rented/borrowed car without giving a prior notice.
11. If all and any of the car interior equipment, such as car documents, car seats, tires, spare parts, jacks, key and etc., becomes defective or lost during the car rental, the
Renter/Borrower must pay all fines as charged by the Lessor/Lender. The Lessor/Borrower shall apply fines according the criteria of price determined by the car service center of
the respective brand and the accrual service fee.
12. If a tire of the care has an air leakage, the Renter/Borrower must fix by recapping the tire for the Lessor/Lender. If a tire is blown out, the Renter/Borrower must buy a new tire of
the same brand and pattern for the Lessor/Lender. If such incident occurs, the Renter/Borrower must notify the Lender of the incident immediately.
13. In event that the rented/borrowed car is seized or fined as a result of the Renter/Borrower’s use of the car, the Lessor/Lender is entitled to ask the Renter/Borrower to pay any fines
or fees in connection with the event in actual amount. If the Renter/Borrower fails to pay such fines or fees, the Lessor/Lender is entitled to withhold the sum from the security
deposit immediately without obtaining a consent and has the right to claim for compensation due to other damages (if any) in actual amount.
14. Duration of the car rental shall be counted from the time the car is picked up until completing 24 hours, which is counted as 1 day. The Renter/Borrower must return the car on time
as agreed at the specified location. If the Renter/Borrower is unable to return the car at the time and location as specified, he/she must notify the Lessor/Lender at least 3 hours
prior to due time for returning the car. The Lessor/Lender has the right to refuse an extension to such rental/borrowing time without breach of this Agreement. In case the
Lessor/Lender agrees to allow an extension to the time of car return, the Renter/Borrower agrees to pay additional service fees as follows.
Example: rental price of 1,000 Baht per day and overtime price of 100 Baht per hour.

1: In an Agreement, if the pickup date is on January 5th, 10.00 AM, and the return date is on January 5th, 18.00 PM.
The rental price shall be charged for 1 full day, which is 1,000 Baht. The car can be returned by 6th of January at
10.00 AM.
2. In an Agreement, if the pickup date is on January 5th, 10.00 AM, and the return date is on the January 6th, 12.00 PM.
The rental price shall be charged for 1 day and 2 hours, which is 1,200 Baht. The Renter/Borrower wants to delay
the car return for further 2 hours, which is on January 6th, 14.00 PM. Additional 200 Baht shall be charged.
Therefore, the total price will be calculated from the rental of 1 day and 4 hours, which is 1,400 Baht.
On the other hand, if the Renter/Borrower wants to delay the car return for further 3 hours, which is on January 6th,
15.00 PM, the rental price shall be charged for 2 full days, which is 2,000 Baht.
*Change to the rental in all cases must be informed to and approved by the Lessor/Lender prior to making such
change.
15. The Lessor/Lender shall not responsible for all and any properties that the Renter/Borrower has forgotten in the rented car.
16. The Renter/Borrower must fill up fuel as required before returning the car. Otherwise, the Lessor/Lender will be able to charge the fuel cost or allowed to deduct the shortfall from
the security deposit immediately. If the Renter/Borrower fills up fuel that is not in accordance with the type specified, the Renter/Borrower agrees to indemnify for all damages
incurred.
17. Under this Agreement, the Lessor/Lender is required to refund the security deposit to the Renter/Borrower in full amount when the Renter/Borrower returns the car, providing that
the Renter/Borrower does not commit a breach of this Agreement and there is not any damage occurred. On the other hand, if the Renter/Borrower commits a breach to any clauses
of this Agreement, the Renter/Borrower allows the Lessor/Lender to forfeit the security deposit immediately and to claim for actual damages. If the Renter/Borrower fails to pay
fines, in case the Lessor/Lender is able to exercise the right of penalty, the Lessor/Lender is entitled to withhold the fines from the security deposit immediately.
18. This Rental Agreement shall be applicable only on the rental/borrowing day(s), including the extended Rental Agreement. If the Renter/Borrower is unable to return the car by the
due date and time and fails to notify the Lessor/Lender immediately, where the return is beyond the due time for over 3 hours, or the Renter/Borrower may not be contacted
whatsoever, the Lessor/Lender/Title Holder/Owner is entitled to report the case to police officers for criminal charge of theft with use of trickery or embezzlement immediately. If
there is any damage or processing cost arisen from this regard, the Renter/Borrower agrees to be liable for it without any dispute.
19. If the Renter/Borrower is in breach of any clause mentioned above, the Renter/Borrower agrees and allows the Lessor/Lender to forfeit the entire security deposit immediately to
remedy the damages primarily. In case the value of damage exceeds the security deposit, the Lessor/Lender is entitled to claim for the damage or brings up the case to the court to
claim for an actual amount of the damage.
20. Drivehub is only an intermediary providing car rental services and shall not be responsible damages or acts arisen from the Lessor/Lender and/or the Renter/Borrower. If the
Renter/Borrower is in breach of any clause of this Agreement and fails to indemnify any damage, Drivehub is not in a position of being an employee, a guarantor, or a joint debtor,
or being jointly responsible for anything in this Agreement. Also, it is understood that if this Rental Agreement has a guarantor, the guarantor has acknowledged the terms and
conditions of this Agreement thoroughly, and the guarantor is binding to be responsible for indemnifying all damages occurred.
Note: Foreign driving licenses are valid in most countries including the Philippines for the next 90 days after arrival. After 90 days foreign driving license is required to be converted to the local standard. Remember that if you are planning a long trip!
