Rental requirements

1. RENTAL PERIOD & RATE Rental Duration: The rental begins on the date and time specified in the booking/receipt and ends precisely at the agreed return time. Late Returns: A grace period of 1 hour is allowed. Thereafter, a late fee of 100 per hour will apply. If the motorcycle is unreturned for more than twenty-four (24) hours past the due date without notice, it will be treated as unauthorized use or carnapping under Republic Act No. 10883 (New Anti-Carnapping Act of 2016), and will be reported to the Philippine National Police (PNP). 2. ELIGIBILITY & DRIVER REQUIREMENTS Under Philippine law, the Lessee strictly covenants that they: Possess a valid, unexpired Driver’s License issued by the Land Transportation Office (LTO) with the appropriate restriction code for motorcycles (Restriction 1 / A or A1). International renters must hold a valid international driving permit or a foreign license valid under LTO regulations (up to 90 days from arrival). Are at least [Insert Age, e.g., 18 or 21] years old. Will not allow any third party to operate the motorcycle. Only the registered Lessee is authorized to drive. 3. SECURITY DEPOSIT & PAYMENT Rental Fee: Must be paid in full prior to or upon the turnover of the motorcycle. Security Deposit: A refundable deposit of P500 or a valid government ID (subject to agreement) is required. This deposit will be refunded upon the safe return of the motorcycle in the same condition as received, less any outstanding traffic fines, fuel shortages, or minor damages. 4. CONDITION OF THE MOTORCYCLE Joint Inspection: Both parties will inspect the vehicle before turnover. Existing scratches, dents, or mechanical defects must be noted in an inspection checklist. Fuel Policy: The motorcycle is delivered with a [Full Tank / Agreed Level] of gasoline and must be returned with the same level. A refueling charge of [Insert Amount] plus fuel cost will apply if returned short. 5. RULES OF USE & COMPLIANCE The Lessee agrees to comply with Republic Act No. 4136 (Land Transportation and Traffic Code) and all local ordinances. Specifically: Helmets: The driver and any authorized pillion rider must wear standard protective motorcycle helmets at all times pursuant to Republic Act No. 10054 (Motorcycle Helmet Act of 2010). Capacity: The motorcycle must not carry more than two (2) people (driver and one passenger). Prohibited Uses: The motorcycle shall not be used: For any illegal purposes, transport of contraband, or commission of a crime. To carry passengers or goods for hire (Grab, Angkas, JoyRide, etc., unless expressly permitted). Off-road, on beaches, or in racing/stunt activities. By any person under the influence of alcohol, drugs, or substances impairing consciousness (Republic Act No. 10586 - Anti-Drunk and Drugged Driving Act). 6. LIABILITY, DAMAGE, & LOSS Pursuant to Article 1667 of the Civil Code of the Philippines, the Lessee is responsible for the deterioration or loss of the thing leased, unless they prove it occurred without their fault. Damage/Theft: In the event of an accident, damage, mechanical breakdown, or theft, the Lessee must notify the Lessor immediately. Accident Repair Costs: The Lessee is liable for the full cost of repairs, parts replacement, and towing fees resulting from accidents or negligence during the rental period. Loss of Use: The Lessee may be charged a daily "Loss of Use" fee equivalent to the daily rental rate for the days the motorcycle is in the shop for repairs due to the Lessee's fault. 7. TRAFFIC VIOLATIONS & FINES The Lessee is solely responsible for all traffic violations, illegal parking fines, towing fees, and impoundment costs incurred during the rental period. If the Lessor pays these fines to retrieve the vehicle or clear its registration, the Lessee shall fully reimburse the Lessor plus an administrative fee. 8. INDEMNIFICATION The Lessee agrees to indemnify, defend, and hold harmless the Lessor from any and all claims, losses, damages, injuries, or death caused to the Lessee, their passenger, or third parties arising from the Lessee’s operation of the motorcycle.
